1 – Introduction
These terms of sale (hereinafter referred to as the "General Terms and Conditions") govern the sale of products marketed by AMC SRL - Via Serravalle, 13 - 23032 Bormio SO, VAT No. 01057240143.
All purchase contracts for products concluded through the stelvio.shop website, and in accordance with the procedures indicated therein, between the Seller and the Customer, shall be governed by these General Terms and Conditions.
2 – Acceptance of the terms of sale
The contract entered into between AMC SRL and the Customer shall be deemed concluded upon acceptance, even partial, of the order by AMC SRL, which reserves the right, at its sole discretion, to accept the order. By placing an order using any of the methods provided, the Customer declares to have read all the information provided during the purchase process and to fully accept the general terms and payment conditions set out below.
If the Customer is an end consumer (i.e. a natural person purchasing goods for purposes unrelated to their professional activity), once the online purchase process has been completed, they must print or save an electronic copy, and in any case retain, these general terms and conditions of sale, in compliance with the provisions of Art. 50 et seq. of Legislative Decree 206/05 "Consumer Code" concerning distance selling.
3 – How to purchase
The Customer may only purchase the products present in the electronic catalog of AMC SRL at the time the order is placed and viewable on the stelvio.shop website, as described in the relevant product information sheets. The technical information entered on the stelvio.shop website faithfully reproduces that of the manufacturers of the goods included in the catalog. AMC SRL therefore reserves the right to modify the technical information of the products to bring it into line with that provided by the manufacturers, without any need for prior notice. It is understood that the image accompanying a product's description sheet may not be perfectly representative of its characteristics, and may differ in color, size, or accessory products shown in the picture.
4 – Shipping methods
AMC SRL undertakes to hand over the products to the appointed carrier within 24-48 working hours (Saturdays, Sundays and public holidays excluded) from receipt of payment of the total amount due, consisting of the purchase price of the product(s) and the shipping costs.
Each listing indicates the specific costs for shipping the item described and offered for sale; in the absence of shipping costs, shipping is to be understood as free. Even where shipping is indicated as free, the possibility remains of a request for a shipping surcharge or any customs clearance costs (where applicable) in areas defined by couriers as "hard to reach," such as the minor islands, the Venice lagoon, Campione d'Italia, or Livigno. The purchased goods will be delivered to the destination address specified by the customer at the time of purchase, and delivery is understood to be at street level. At the time of delivery of the goods by the courier, the Customer is required to check: - that the number of packages delivered corresponds to what was ordered; - that the packaging is intact, undamaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal straps). Any damage to the packaging and/or product, or any mismatch in the number of packages or in the details, must be reported to the courier immediately, by noting a WRITTEN INSPECTION RESERVATION on the courier's proof of delivery.
Once the courier's document has been signed, the Customer may not raise any objection regarding the external characteristics of the delivered goods. Even where the packaging is intact, it is advisable to add the note "collected with reservation." The goods must be checked within 48 hours of receipt. If the note "collected with reservation" has not been added at the time of collection from the courier, it will not be possible to initiate refund procedures. Once the courier's document has been signed, the customer may not raise any objection regarding the external characteristics of the delivered goods. Any problems regarding the physical integrity, correspondence, or completeness of the products received must be reported within 5 days of delivery, in accordance with the procedures set out in this document.
5 – Payment methods
PayPal
In the event of purchase using the PayPal payment method, upon completion of the order the Customer is directed to the PayPal login page.
The amount relating to the order is charged to the PayPal account at the time the order is accepted.
In the event of order cancellation, whether by the Customer or due to non-acceptance by AMC SRL, the amount will be refunded to the customer's PayPal account.
Cancellation of the order is possible up until the point at which it has not yet begun being prepared in the warehouse.
Once cancellation of the transaction has been requested, AMC SRL cannot under any circumstances be held liable for any damages, direct or indirect, caused by delay in the release of the amount held by PayPal. At no point in the purchase process is AMC SRL able to access the Customer's financial information. Since no such data is transmitted, there is no possibility of this data being intercepted. No AMC SRL database contains or stores such data.

7 – Jurisdiction and applicable law
The sales contract between the Customer and AMC SRL is understood to be concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, territorial jurisdiction lies with the court of the Customer's municipality of residence; in all other cases, territorial jurisdiction lies exclusively with the Court of Sondrio.
8 – Use of the site
All Users must use the site in strict compliance with these terms of sale. It is forbidden to provide false personal details or to engage in any conduct likely to create confusion regarding the personal identity of the user. By way of example, this prohibition includes: using a name, personal details, or address that are untrue or belong to someone else. By accepting the aforementioned Registration Terms and Conditions, the participant declares, under their own responsibility, that the data provided is true and belongs to the person making the declaration.
The User undertakes not to use the shop and its related services for illegal purposes or purposes contrary to these terms and conditions of use, or in ways that could damage its functionality, render it inoperable, cause overload, deterioration, and/or interference with its use by other Users.
Any conduct that could, even through mere attempts, result in unauthorized access to the shop, to other accounts, or to systems or networks connected to it, through hacking, password forgery, or other means, is prohibited.
The user undertakes to keep the authentication credentials needed to access the shop with the required diligence.
9 – Processing of personal data
The Customer's data is processed by AMC SRL in accordance with the provisions of the legislation on the protection of personal data, as specified in the notice provided in the dedicated privacy policy section.
10 – Security and confidentiality
The personal data requested when placing an order is collected by AMC SRL and processed on IT media, in order to fulfill the obligations arising from the contract concluded with the customer, and will under no circumstances and for no reason be disclosed to third parties. AMC SRL guarantees its customers compliance with the legislation on the processing of personal data. The data controller is AMC SRL, with registered office at Via Giuliani, 21 - 23100 - Sondrio (SO). The customer is entitled, at any time, to withdraw consent to the processing of personal data by written communication sent to the registered office of AMC SRL. Marketing communications will only be sent with the customer's explicit consent, given together with authorization for processing and sending in the online registration form.
11 – Intellectual property
The content of the Site is protected by copyright and intellectual property legislation. Reproduction of the Site's content for commercial use or in any case for the purpose of deriving any benefit from it is therefore strictly prohibited, unless prior written consent to that effect has been given by AMC SRL.
